General Terms and Conditions of Sale

2. Scope of application

These General Terms and Conditions of Sale govern purchases made through this website (Brilla, brilla.pegame.es). By placing an order, the user fully accepts these terms and conditions.

3. Products

The products we sell are personalised light objects: lithophanes, lamps and decorative pieces that incorporate lighting or illuminated parts, manufactured on demand by 3D printing.

  • Personalised products are manufactured from the photograph, image, text or specifications provided by the customer (for example, a lithophane made from a photo). As goods made to the consumer's specifications, they are considered personalised products.
  • Catalogue products are Pegame's own designs, manufactured on demand without customer personalisation.

Each product page states whether the product is personalised or a catalogue product, as well as the type of lighting it incorporates and how it is powered.

4. Characteristics inherent to 3D printing and lithophanes

  • Pieces are manufactured layer by layer by 3D printing. Layer lines, small support marks and slight variations in shade, texture or dimensions (within the usual margins of this technique) are inherent to the manufacturing process and do not constitute a defect.
  • A lithophane reproduces the image through the thickness of the material and can only be properly appreciated with the lighting switched on. When switched off, the piece shows a relief in a uniform shade.
  • The result depends on the quality of the image provided (resolution, contrast, sharpness). Before manufacturing, Pegame may warn the customer if the image is unsuitable and suggest alternatives, but does not guarantee a result identical to the on-screen preview.
  • Colours and the appearance of the images on the website are indicative. The actual lighting may differ slightly in shade and intensity.

5. Images and designs provided by the customer. Intellectual property

Any customer submitting a photograph, image or design for reproduction declares that they hold the intellectual property rights or have the authorisation of the rights holder and, in the case of images of people, that they have the consent of the people appearing in them. Pegame acts exclusively as the manufacturer of the physical object and assumes no responsibility for the ownership or content of the images provided by the customer.

Images and designs provided are used exclusively to manufacture the order and are processed in accordance with our Privacy Policy.

Designs that reproduce third-party trademarks, logos or characters are only manufactured upon the customer's express declaration that they hold the authorisation of the rights holder or that the use is strictly personal and non-commercial. Pegame does not act as a licensee or intermediary of any third-party trademark.

  • The purchase of a product bearing a third-party logo, trademark or character does not imply authorisation for its commercial use.
  • Responsibility for the use of a product bearing third-party content lies entirely with the buyer.
  • The customer undertakes to indemnify and hold Pegame harmless against any claim, damage or expense (including legal fees) arising from an infringement of intellectual property, industrial property or image rights caused by the content provided by the customer.

Pegame reserves the right to refuse and cancel orders whose content is unlawful, offensive or infringes third-party rights, refunding the amount paid in that case.

6. Prices and taxes

  • The prices shown on the website include the applicable VAT (21%), except in the case of a typographical error.
  • Pegame reserves the right to modify prices at any time, although products will be invoiced at the price in force at the time the order is confirmed.

7. Shipping costs

  • Where applicable, the amount of the shipping costs will be visible in the shopping cart before payment and will be detailed in the order confirmation email.
  • Shipping costs, if any, are borne by the customer.
  • Shipments are made only to mainland Spain and the Balearic Islands.
  • No shipments are made to the Canary Islands, Ceuta, Melilla or outside Spain.
  • Products are packaged with protection appropriate to their fragility. If the parcel arrives visibly damaged, we recommend noting it with the carrier and informing us within the period stated in section 11.

8. Payment methods

We accept the following payment methods:

  • PayPal: a PayPal account is not required; the main credit and debit cards are accepted through its gateway.
  • Stripe: direct payment by credit or debit card.

After completing payment, you will receive an order confirmation email. The order will be processed once payment has been made effective.

9. Purchase process and delivery times

  1. The customer selects the product and its options and, for personalised products, provides the required photograph, image or text.
  2. Reviews the cart, enters their shipping details and proceeds to payment.
  3. Receives an order confirmation email.
  4. Pegame manufactures the piece on demand by 3D printing, assembles it with its lighting module, checks it and ships it.
  • The estimated delivery time is approximately 5 to 8 working days from payment confirmation. This time frame is indicative and may vary due to public holidays, high demand, manufacturing time or carrier incidents. It will in no case exceed 30 calendar days from payment confirmation.
  • If the image provided requires clarification or replacement, the time frame will start when the customer provides the final image.
  • Pegame is not responsible for delivery incidents caused by an incorrect address provided by the customer or by failure to collect the parcel at the delivery point within the stated period.

10. Right of withdrawal

Personalised products. In accordance with article 103.c) of Royal Legislative Decree 1/2007 (General Law for the Protection of Consumers and Users), the right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalised. Products manufactured from the customer's photograph, image, text or specifications are therefore excluded from the 14-day right of withdrawal.

Catalogue products. For products without personalisation, the customer has 14 calendar days from receipt to withdraw from the contract without giving any reason, by notifying info@pegame.es. The product must be returned complete, unused and in its original packaging; return costs are borne by the customer. The refund will be made within 14 days of receipt of the returned product, using the same payment method.

11. Returns and complaints

  • If the product received has a manufacturing defect, a lighting module failure, transport damage or there has been an error in the order (wrong item, incorrect option), the customer has 15 calendar days from receipt to report it to info@pegame.es, attaching photographs of the problem.
  • Pegame will proceed with the repair, replacement of the product or a refund, as appropriate and at the customer's choice where the law so provides.
  • Return costs will be borne by Pegame when the reason is an error attributable to us, a defective product or transport damage.

12. Safe use of the product

  • The products incorporate low-voltage LED lighting. Use only the power supply or type of connection stated on the product page (for example, 5 V USB). Do not connect the product to other power sources or tamper with its electrical installation.
  • Product for decorative indoor use. Keep it away from water, humidity, heat sources and prolonged direct sunlight: the printed material may deform at high temperatures.
  • Not a toy. Contains small parts and electrical components; keep out of the reach of young children.
  • Clean the piece only with a dry or slightly damp cloth, with the product unplugged.

13. Legal guarantee

In accordance with Royal Legislative Decree 1/2007 and Directive (EU) 2019/771, the products come with a 3-year legal guarantee from delivery against lack of conformity.

This guarantee covers:

  • Manufacturing defects in the printed piece or the lighting module that appear during the guarantee period.
  • Products that do not match the description or the characteristics indicated on the website.

Not covered:

  • The characteristics inherent to 3D printing and lithophanes described in section 4.
  • Damage arising from knocks, drops, incorrect use or installation, exposure to water or heat sources, or the use of power supplies other than those indicated.
  • Tampering with or modification of the product or its electrical components by the customer or third parties.
  • Normal wear from regular use of the product.

14. Applicable law and dispute resolution

These terms and conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the consumer's domicile, in accordance with the applicable regulations.
